This website (cheatcode.com.au) is operated by EFCOMM Pty Ltd (ACN 607 661 727 / ABN 72 607 661 727) trading as Cheat Code ("we", "us", "our").
By using this website, submitting an enquiry or application, or subscribing to our mailing list, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site. We may update these terms at any time by publishing a new version here.
The site is intended for users aged 18 and over, in Australia and New Zealand.
2. Information on this site
Everything on this site is general information about our business. It isn't professional, financial, career or legal advice, and it isn't an offer capable of acceptance or an offer of employment.
Any work we do for a client is governed by a separate written agreement. Sending us an enquiry doesn't create a contract or any obligation on us to provide services.
We take reasonable care to keep the site accurate and current, but we don't warrant that it is complete, error-free or suitable for your purposes, and we may change or remove content at any time.
3. Careers and applications
Applying through this site is an expression of interest only. It doesn't create an offer of employment or any binding obligation on either of us.
You warrant that the information you give us — including your work history, qualifications and right to work — is true and complete, and you agree we may contact you by phone, SMS or email about your application. Any role that follows will be governed by a separate written agreement.
Any incentive or guarantee referred to in a job ad applies only on the terms notified to you at the time, and only to people we engage who meet those terms.
4. Earnings and results
Any figures we publish about income, base rates, commissions, bonuses, on-target earnings or promotion timeframes are estimates based on our general experience.
Actual earnings depend on individual effort, skill, sales performance, campaign, hours worked and market conditions. We do not guarantee any particular income, commission, promotion or career outcome.
The same applies to client results. Sales figures, growth and return-on-investment outcomes we refer to were achieved in specific circumstances and are not a promise of comparable results for your business. Awards and rankings relate to the year and program stated.
5. Testimonials
Testimonials and reviews are the genuine views of the people who gave them at the time. They're individual experiences, not a representation of what every client, employee or student will experience. They may be edited for length or clarity.
6. Intellectual property and acceptable use
All content on this site — including copy, images, video, training materials, design and the CHEAT/CODE name and marks — is owned by or licensed to us. You may view, download and print it for your own personal, non-commercial use. Anything else — reproducing, republishing, reselling, scraping or using our materials commercially — needs our written permission.
You must not use the site unlawfully, interfere with its operation or security, harvest contact details from it, or submit false or misleading enquiries or applications.
7. Anything you send us
If you send us content through the site — enquiries, applications, résumés, reviews, photos or feedback — you confirm it's yours to send and doesn't infringe anyone's rights, and you give us permission to use and publish it to operate and promote our business, including on social media. You can withdraw consent for marketing use of a testimonial or image in writing and we'll stop using it going forward. We may edit, remove or decline to publish anything you send.
8. Privacy and communications
We handle personal information in line with our Privacy Policy, the Privacy Act 1988 (Cth) and the Privacy Act 2020 (NZ).
By giving us your email or phone number you consent to us contacting you about your enquiry, application or account. Where you've opted in, you also consent to marketing by email and SMS. You can unsubscribe any time using the link in any email, by replying STOP to any SMS, or by emailing [CONTACT EMAIL].
9. Third party links
We link to and embed third party services (social media, video, payment and booking tools, job boards). We don't control them and aren't responsible for their content, availability or privacy practices. Your dealings with them are between you and them.
10. Your rights and our liability
Our services come with guarantees that can't be excluded under the Australian Consumer Law and, for New Zealand consumers, the Consumer Guarantees Act 1993 (NZ) and Fair Trading Act 1986 (NZ). Nothing in these terms excludes, restricts or modifies those rights.
Where we can lawfully limit our liability, it is limited (at our option) to resupplying the services or paying the cost of having them resupplied. To the maximum extent permitted by law, we're not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss of anticipated earnings arising from your use of this site, and our total liability is capped at the amount you've paid us in the previous 12 months or AUD $100, whichever is greater.
You're responsible for any loss we suffer as a result of your breach of these terms or misuse of the site.
11. General
These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the Queensland courts. If you're a consumer in New Zealand, this doesn't remove the protection of New Zealand consumer law or your right to bring proceedings there.
If any part of these terms is unenforceable, it's severed and the rest continues to apply. We can restrict or suspend access to the site if these terms are breached.
